Its postal address is Carretera Sacedón, KM 42, 16512 Buendía, Cuenca, Spain, and its e-mail address is info@palolivo.com (hereinafter THE SELLER’S ADDRESS). In Switzerland, the company is registered under the full name Pal’Alcarria SL – Succursale Suisse in the Commercial Register with the address: Route de la Rivaz 21, 1844 Villeneuve, Vaud, Switzerland.

Any order placed on the www.palolivo.com website (hereinafter referred to as THE VENDOR SITE) implies full acceptance of these terms and conditions of sale, formalized by a validation click which is equivalent to a digital signature.

Object

The present conditions define the rights and obligations of the parties in the context of the online sale of goods offered by Pal’Alcarria SL.

Order Confirmation

Contractual information will be confirmed by e-mail to the address indicated by the consumer at the time of the order.

Proof of Transaction

The computerized records kept in Pal’Alcarria SL ‘s computer systems are considered proof of communications, orders and payments. Purchase orders and invoices are archived on a reliable and durable medium that can be produced in the event of a dispute.

Offer Validity Period

Our prices are valid on the day the order is placed.

Terms of delivery

Products are delivered to the address indicated by the consumer, in the geographical zones served by THE SELLER. All products leave our premises in perfect condition. In the event of visible damage (holes, crushing), the customer must notify the carrier and refuse the package if necessary. Pal’Alcarria SL must be informed immediately for a replacement free of charge.

In the event of delay or loss of the parcel, we will contact the carrier and make every effort to recover it. THE SELLER declines all responsibility in the event of late delivery due to the carrier, weather conditions or strikes.

Carrier Delivery Problem

Any anomaly concerning delivery (damage, missing product, damaged package, etc.) must be noted on the delivery slip and confirmed to the carrier by registered letter within two working days of receipt. A copy of this complaint must be sent to THE SELLER’S ADDRESS.

Delivery errors

Any claim of error or non-conformity must be made to the SELLER on the day of delivery or at the latest on the first working day thereafter. No claims will be accepted after this deadline. Returned products must be in their original packaging and in perfect condition.

Product warranty

Consumers benefit from the legal warranty against hidden defects. In the event of damage caused by a product defect, only the manufacturer may be held liable. The warranty period is one year. Products modified or repaired by the customer or an unauthorized third party are excluded.

Right of withdrawal

Consumers have 14 days to return products at their own expense. Items must be returned complete and in perfect condition to be reimbursed. In the event of retraction, THE SELLER will reimburse the consumer within 14 days.

Force Majeure

Neither party shall be liable for any delay or impediment resulting from force majeure. The parties will contact each other within ten days of learning of the event to agree on how to continue the contract.

Partial non-validation

If any provision of these terms and conditions is found to be invalid, the remaining provisions shall remain in full force and effect.

Non-Waiver

Failure by either party to enforce any provision hereof shall not be construed as a waiver of such provision.

Applicable Law

The present conditions are subject to Swiss law. In the event of a dispute, the consumer will first contact the SELLER to find an amicable solution.

Privacy Policy

Personal data is collected to process orders. In accordance with the law, the consumer has the right to rectify and delete data concerning him or her.

Disputes

Any order placed via THE VENDOR SITE implies the customer’s acceptance of these terms and conditions. In the event of a dispute with a legal entity, the Commercial Court of the SELLER ‘s registered office shall have sole jurisdiction.
